The Data Controller, Neurologie Mištríková, Neurologická ambulance pro dospělé, s.r.o., with its registered office at Vídeňská 255/42, 639 00 Brno, address of healthcare provision: Jugoslávská 11/13, 613 00 Brno, ID No. (IČ): 216 68 418, is a healthcare provider based on a valid authorization to provide healthcare services, in accordance with Act No. 372/2011 Coll., on Healthcare Services.
In connection with the provision of healthcare, we are obliged to collect personal data about you—the patient—to the extent necessary for providing and reporting healthcare services. The scope of the collected personal data is determined by applicable legislation. If we record your personal data beyond the obligations set forth by legal regulations, we will always request your prior written consent.
We collect and use your personal data exclusively in connection with providing healthcare to you. We are also obliged to disclose your personal data when reporting covered healthcare services and fulfilling other statutory obligations, such as tax and accounting duties, and as part of notifications to certain disease registries specified by law. We disclose your personal data to authorized entities and institutions only in cases where this obligation is imposed on us by legal regulations. Persons authorized to access your personal data are also bound by law to protect personal data and maintain professional confidentiality.
The data maintained about you in your medical records primarily includes facts necessary for your identification, data on performed examinations, or established diagnosis, treatment, prescribed medicinal products or medical devices, results of comprehensive and follow-up examinations, or your informed consent or dissent to individual procedures and treatment.
We store your personal data for the period specified by legal regulations. In particular, reference can be made to Decree No. 98/2012 Coll., on Medical Documentation, which stipulates the period for which it is necessary to retain a patient's medical documentation. Furthermore, reference can be made to legal regulations regarding accounting and tax obligations, which also define the archiving period for which documents proving the provision of healthcare must be archived. In cases of fulfilling a contractual obligation, such as the provision of healthcare not covered by public health insurance, the registration of your contacts in the booking system, etc., we collect this personal data for a period of one year from the time you ceased to receive healthcare services from our medical facility, or until you withdraw your consent.
Your Rights in Connection with the Collection of Personal Data During the Provision of Healthcare Services
As a patient, you have the right to access your personal data. If you find that the personal data is not kept correctly or is inaccurate, you have the right to request the rectification of your personal data. You also have the right to erasure of your personal data to the extent of voluntarily provided personal data, i.e., within the framework of fulfilling contractual obligations. Conversely, it is not possible to claim the erasure of personal data that the healthcare provider is obliged to collect based on a legal obligation (an obligation imposed by law), i.e., in connection with the healthcare services provided to you.
As a patient, you may file a complaint with the supervisory authority if you believe that the processing of your personal data violates personal data protection regulations. You can lodge a complaint with the supervisory authority, which for the territory of the Czech Republic is the Office for Personal Data Protection (Úřad pro ochranu osobních údajů), located at Pplk. Sochora 27, 170 00 Prague 7 (www.uoou.cz).
